The latest Legal Briefs video addresses SB 1968 and the legislative updates to The Real Estate Licensing Act (TRELA). Beginning January 1, 2026, subagency will no longer be permitted in Texas. This applies to all sectors of real estate, including residential, farm & ranch, vacant land, and commercial.

The changes ensure that all parties clearly understand who represents whom, along with the duties and obligations involved.  With subagency no longer an option, a license holder will be able to represent the seller as the seller’s agent, represent the buyer as the buyer’s agent, or represent both seller and buyer as an intermediary.

Also beginning January 1, 2026, a license holder may show properties without representing the buyer, provided they meet specific conditions and avoid offering advice.
